Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Stay Healthyr mobile application and website (the "Service") operated by Stay Healthyr ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Use of the Service

1.1 Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for safeguarding your password and for all activities that occur under your account.

1.2 Acceptable Use

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • To transmit any material that is defamatory, obscene, or otherwise objectionable.
  • To impersonate or attempt to impersonate Stay Healthyr, a Stay Healthyr employee, another user, or any other person.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service.
  • To attempt to, or actually access data not intended for you, such as logging into a server or account that you are not authorized to access.

2. User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting User Content to the Service, you grant us the right and license to use, modify, perform, display, reproduce, and distribute such material on and through the Service.

You represent and warrant that:

  • You own the User Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses to us.
  • The posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

3. Health Information and Fitness Recommendations

The Service provides health tracking, nutrition information, and fitness recommendations which are intended for general informational purposes only. The content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Stay Healthyr does not claim to diagnose, prevent, or treat any illness, and the Service should not be used for these purposes. You should not disregard professional medical advice or delay seeking it because of something you have read or seen on the Service.

4. Subscriptions

4.1 Billing

Some features of the Service require a subscription with a recurring payment. By selecting a subscription, you agree to pay us the subscription fee indicated for that service. Payments will be charged on the day you sign up for a subscription and will cover the use of that service for the period indicated.

4.2 Automatic Renewal

Unless you cancel at least 24 hours before the end of the current period, subscriptions automatically renew. You authorize us to collect the then-applicable fee for the renewal term using the payment method on file.

4.3 Free Trials

We may offer free trials of our subscription service. If you begin a free trial, we will begin billing your payment method for the subscription fee at the end of the free trial period unless you cancel prior to the end of the free trial period.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Stay Healthyr and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Stay Healthyr.

6. Limitation of Liability

In no event shall Stay Healthyr, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use or alteration of your transmissions or content.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account from within the service settings.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
